Affiliate Program Terms

These terms establish the conditions applicable to the Create Music Affiliate Program, in compliance with Brazilian legislation, including the General Data Protection Law (Law No. 13,709/2018 – LGPD) and current labor legislation.
1. Program Objective
The Affiliate Program aims to allow individuals to recommend the products of the "Create Music" platform, consisting of personalized songs created on demand, through trackable links, in exchange for commissions on effectively completed sales.
2. Who Can Participate
2.1. Any individual may participate who is:
- over 18 (eighteen) years of age;
- holds a valid CPF (Brazilian tax ID);
- is a resident or domiciled in Brazil;
- fully accepts these terms.
2.2. It is not necessary to hold a CNPJ (business registration), have a formal company, or any formal commercial relationship.
2.3. Participation is free, voluntary, and non-exclusive.
3. Registration and Enrollment
- 3.1. Interested parties must register through the official Affiliate Program page.
- 3.2. Upon registration approval, the participant will receive an exclusive trackable link, which will be the sole valid means for tracking sales and commissions.
- 3.3. Enrollment in the program implies full agreement with these terms and the platform's Privacy Policy.
4. Nature of the Relationship – No Employment Bond
4.1. Participation in the Affiliate Program does not create any employment, corporate, associative, commercial representation, or franchise relationship between the affiliate and IA.Puru - Inovação e Tecnologia LTDA.
4.2. The requirements set forth in Article 3 of the Brazilian Labor Code (CLT) are not present, individually or cumulatively, such as:
- legal subordination;
- mandatory regularity;
- personal obligation;
- exclusivity;
- working hours control.
4.3. The affiliate acts autonomously and independently, and may:
- freely choose if, when, and how to share the links;
- simultaneously participate in other programs or activities;
- discontinue participation at any time.
4.4. There is no payment of salary, employment benefits, vacation pay, 13th salary, FGTS, or any other labor or social security benefits.
5. Promotion Methods
5.1. The affiliate may share their exclusive link through digital means, such as:
- social media;
- messaging apps;
- blogs;
- emails;
- personal websites.
5.2. The use of emotional communication, storytelling, and testimonials is permitted, provided they are truthful.
5.3. The following are expressly prohibited:
- promising results, deadlines, or features not offered by the platform;
- engaging in spam or abusive outreach;
- using paid advertisements with the name or brand "Create Music" without authorization;
- presenting oneself as an employee, official representative, or customer service agent of the company.
6. Commissions
- 6.1. The affiliate is entitled to a commission on each sale effectively completed through their exclusive link.
- 6.2. The base commission is 25% (twenty-five percent) of the net sale value.
- 6.3. The commission may be increased based on monthly performance:
- 30% after 10 sales in the same month;
- 35% after 30 sales in the same month.
- 6.4. Tier progressions are valid only for the current month and reset at the beginning of each new month.
7. Attribution Window
- 7.1. The standard attribution window is 30 (thirty) days, counted from the customer's first access through the affiliate's link.
- 7.2. During specific seasonal campaigns, the window may be extended up to 60 (sixty) days, with prior notice.
8. Payments
- 8.1. Commission payments will be made biweekly, according to the following schedule:
- 5th of the month: sales made between the 16th and 31st of the previous month;
- 20th of the month: sales made between the 1st and 15th of the current month.
- 8.2. Payment will be made via PIX to an account held by the Affiliate, as indicated at the time of registration.
- 8.3. A minimum withdrawal amount may be set. If not reached, the balance will be automatically accumulated.
- 8.4. Cancelled, refunded, incomplete, or fraudulent sales do not generate commission rights.
9. Personal Data Protection (LGPD)
9.1. Personal data provided by the affiliate will be processed in compliance with Law No. 13,709/2018 (LGPD).
9.2. Data will be used exclusively for:
- Affiliate Program management;
- sales and commission tracking;
- payment processing;
- operational and institutional communication.
9.3. The affiliate may, at any time, exercise their rights under the LGPD, including:
- access;
- correction;
- update;
- deletion, when applicable.
9.4. Data will not be shared with third parties, except when necessary for compliance with legal or operational obligations.
10. Suspension or Cancellation
10.1. The "Create Music" platform may suspend or cancel the affiliate's participation in case of:
- violation of these terms;
- illegal, abusive, or deceptive practices;
- misuse of the brand;
- at the sole discretion of "Create Music", unilaterally, without prior notice, whenever it determines that maintaining the partnership is no longer compatible with its commercial or institutional interests.
10.2. Whenever possible, the company will prioritize guidance and correction before applying penalties.
11. Amendments to the Terms
- 11.1. The "Create Music" platform may amend these terms at any time by publishing them through official channels.
- 11.2. Amendments will take effect from the date of publication.
12. Final Provisions
- 12.1. The Affiliate Program does not constitute a job offer, partnership, franchise, or commercial representation.
- 12.2. Any questions may be addressed through the platform's official channels.
