1. Acceptance of Terms

Create Music is a SaaS (Software as a Service) platform operated by IA.Puru - Inovação e Tecnologia LTDA. By accessing or using our services, you agree to comply with and be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our platform.

2. Service Description

Create Music is a platform that allows users to create personalized songs through artificial intelligence. The service includes:

• Creation of personalized songs based on user-provided stories
• Credit system for song generation
• Sharing of created songs
• Download of generated audio files
• Account management and creation history

3. Registration and Account

3.1. Eligibility

You must be at least 18 years old to use our services. By creating an account, you declare and warrant that you have legal capacity to agree to these terms.

3.2. Account Responsibility

• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activities that occur in your account
• You must notify us immediately about any unauthorized use of your account
• Sharing or transferring your account to third parties is not allowed

3.3. Accurate Information

You agree to provide true, accurate, current, and complete information during the registration process and to keep this information updated.

4.1. Credit System

• Creating songs requires the use of credits
• Credits can be purchased through payment packages
• Credits don't expire while your account is active
• Credits are non-refundable, except when required by law
• Credits are personal and non-transferable

4.2. Payments

• We process payments through secure third-party providers (Stripe)
• All prices are in Brazilian Reais (BRL) and may be subject to applicable taxes
• You authorize charges to the payment method provided
• We reserve the right to modify prices with prior notice

4.3. Refunds

Unused credits are non-refundable. Only in exceptional cases, such as technical failures that prevent service use, may we offer additional credits or a refund, at our discretion.

5. Acceptable Use

5.1. You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Create content that is defamatory, offensive, obscene, or violates third-party rights
• Attempt to access, tamper with, or use non-public areas of the system
• Reverse engineer, decompile, or attempt to extract source code
• Use automation, bots, or scripts to access the service without authorization
• Overload or interfere with the service infrastructure
• Resell or redistribute the service without express authorization
• Create songs impersonating or using third-party voices without consent

5.2. User Content

You are solely responsible for the content you submit to the platform, including audio and information provided. You warrant that you have all necessary rights to that content and that it does not violate third-party rights.

6. Intellectual Property

6.1. Generated Songs

Songs created through the platform are generated by artificial intelligence based on your stories:

• You have a license for personal and non-commercial use of the generated songs
• For commercial or public use of the songs, prior contact is necessary for appropriate licensing
• You can share the songs for personal purposes through the platform's links
• The technology and algorithms used for generation are owned by IA.Puru and partners

6.2. Platform

All rights, titles, and interests in the platform, including software, design, brand, and content, are the exclusive property of Iapuru Tecnologia and its licensors.

7.1. Disclaimer of Warranties

• We do not guarantee that the service will be uninterrupted, error-free, or completely secure
• We do not guarantee specific results from generated songs (artistic quality is subjective)
• We may perform maintenance that temporarily affects availability
• We are not responsible for problems caused by third parties (AI partners, payment providers, etc.)

7.2. Limitation of Liability

To the maximum extent permitted by law:

• We will not be liable for indirect, incidental, special, or consequential damages
• Our total liability will not exceed the amount paid by you in the last 12 months
• We are not responsible for improper use of the service or generated content

8. Privacy and Data Protection

The processing of your personal data is governed by our Privacy Policy, which is an integral part of these Terms of Service. By using our services, you agree to the collection and use of information as described in the Privacy Policy.

9. Suspension and Termination

9.1. By You

You can terminate your account at any time through settings or by contacting us. Unused credits will be lost.

9.2. By Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms of Service
• We detect fraudulent or abusive use
• We are required by law or court order
• We decide to terminate the service (with reasonable prior notice)

10. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes via registered email or notice on the platform. Continued use after modifications constitutes acceptance of the new terms.

11. General Provisions

11.2. Dispute Resolution Any dispute related to these terms will be resolved primarily in an amicable manner. If not possible, the forum of São Paulo will be competent to resolve controversies.

11.3. Severability If any provision of these terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

11.4. Entire Agreement These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and Iapuru regarding the use of the service.
